JUDICIAL COOPERATION REPORT PUBLISHED BY THE EUIPO

The EUIPO has just published a Report on international judicial cooperation within the EU and internationally in online IP infringement cases for the benefit of right holders, law enforcement agencies, judiciary and policy makers.

The study looks at the legislative measures available for judicial cooperation in civil, administrative and criminal cases of online IP infringement, also providing practical examples of successful applications thereof.

The reason for this report is the quick evolvement of the online environment where IP criminals take advantage of anonymity technologies, the Darknet and its hidden services as well as the borderless nature of the internet to avoid detection, enforcement action and sanctioning.

As identifying suspects and collecting evidence have become more difficult, combatting online IP infringement increasingly requires cooperation and exchange of expertise and information among the judiciaries, regulators and agencies.
