The European Commission has published the
‘Patent Package’ with the aim of making the patent system more effective by further eliminating Single Market fragmentation, reducing red tape and enhancing efficiency.
The proposed regulations are focused on the following
key areas:
• Standard essential patents (SEPs)
• Compulsory licensing of patents in crisis situations
• Revision of le legislation on supplementary protection certificates (SPCs)The
EUIPO is proposed to become a competence centre to support transparency and FRAND determination in relation to SEPs, as well as the responsible body for a centralised examination procedure to be implemented in close cooperation with EU IP offices.
These proposals will
complement the Unitary Patent system, which will be operational as of 1 June 2023.
