Gustavo Andrés Martín Martín

Judge, Commercial Court Number 1 of Alicante, EU Trademark Court, ES 

Dr. Gustavo Andrés Martín Martín is a Spanish judge currently appointed at the Commercial Court n.1 of Alicante and Coordinator of the First Instance Tribunal of EU Trademarks and Community Designs of Spain.

Gustavo Martin joined the judiciary in 2013 an, in 2021, got promoted as specialist in Commercial matters, ranked 1st in his promotion.

He holds a degree in Law from the University of Salamanca with several stays in the United Kingdom at the University of Westminster and the London School of Economics and also a Master's Degree in Private Property and an International PhD in Law from the University of Salamanca and the Public University of Navarre obtaining the qualification of Summa Cum Laude and the José Manuel Gómez Pérez Award for academic excellence. He obtained a research scholarship at the Max Planck Institute for Competition and Innovation (Munich) during his doctoral stay.

Gustavo Martín is mainly concerned with the protection of intellectual property rights in a competitive market. His lines of research have mainly focused on the enforcement of Competition and Unfair Competition Law, a field that now complements with his professional activity at the EU Trademarks Court, essential for the protection of Intellectual Property Rights in the European Single Market. In this regard, he is particularly concerned with the interrelation between exclusive rights and Unfair Competition Law and have issued some relevant decisions, such as Sticks de Turron [2022], Cuétara [2023], Mar de Frades [2023] and Tous [2023], and developed important initiatives in procedural matters, ruling also in the first decision on a Metaverse infringement in Spain, one of the first decisions in EU.

As academic, Gustavo Martin is guest lecturer at the Magister Lvcentinvs- Master in Intellectual Property since 2022. He is also active in national and international forums on Trademark and Design Law, Competition and Unfair Competition Law, as well as Insolvency Law.

In 2023, he has initiated the first applied AI project in a Spanish court, which is currently ongoing.

Currently, represents Spain as a member of the Association of European Competition Law Judges and is part of the Steering Committee of the Madrid Competition Litigation Seminar since 2023, contributing to the continuous development of the legal field
